Supreme Court legalizes downloading music

Reuters, AFP, RT.com, Wisdom Quarterly
The United State Supreme Court has refused an appeal that would have made downloading music an infringement of Federal copyright law. Take that, Metallica (AFP/Andre Durao).

The American Society of Composers, Authors, and Publishers, or ASCAP, had been attempting to appeal to the Supreme Court an earlier ruling by an appeals court in New York that said a downloaded song constituted a public performance of the song under federal copyright law.

Attorneys for ASCAP were fighting to reverse that decision in hopes that they’d be able to collect additional royalties off of songs downloaded from the Web.

ASCAP had insisted that digital downloads were on par with public performances, which would thus allow copyright owners to receive compensation for each download. A federal judge and an appeals court had rejected that argument, however, and now the Supreme Court is also refusing to hear it.

According to the appeals court, “Music is neither recited, rendered, nor played when a recording (electronic or otherwise) is simply delivered to a potential listener.”

US Solicitor General Donald Verrilli agreed with the appeals ruling and that just because a song was transferred over the Internet did not mean that it was being performed, reports Reuters. More

"Actually, Butthead, I'm not into Metallica anymore. They suck ever since that Napster thing!" "Huh huh huh, you said 'suck,' Beavis." "Oh yeah, huh huh huh, huh huh huh, huh huh huh."

Obama Goes Republican (still can't win)

Wisdom Quarterly (ANALYSIS)
Selling out at every turn wedded to opinion polls and willing to say whatever it takes (justpolitics)

American Jobs Act (is all an act)
Today B.S. (Barry Soetoro) Obama addressed the nation to pander to what pollsters and his PR firm told him people wanted to hear, particularly Republicans. He said it -- jobs, jobs, jobs for everyone. Cut corporate taxes. Cut the deficit. Minimize government. Fix the roads. Free money for all. Raw-raw-raw, we're Number One! USA, USA, USA, USA!

Obama's speech fails to unite US... over his speech again (nymag.com).

And for all that, concession man got only yawns of disinterest from his new party. Maybe his dissemblance and mendacity have worn thin his message. No one believes it anymore... except the corporations who (s)elected him and stand to benefit the most.

He is so clearly misleading by oration, making empty promises, uttering almost the opposite of what he knows to be true, all for what? To be re(s)elected? To buoy the jobless. To stick it to the opposition? The mainstream media must have had advanced notice and have their spin-doctoring and supportive propaganda ready to go. Let the onslaught begin.

Brown nosing or white facing, Barack bows to Boehner and the Republican party even before they ask (truff pix).

[So how could we leave Iraq, Pakistan, Tajikistan, Afghanistan, Airport Security Area, or the Internet? We must extend these costly and illegal/unethical wars and fight, fight, fight. We are sure taxpayers understand. Hey, and nice that we say this right around 9/11 to keep people cowering and cooperating. Who says the CIA/Pentagon are not geniuses?]

Apple's newest release: The "iQuit"

Wisdom Quarterly (ANALYSIS)

The Steve Jobs and Apple Story (Telegraph.co.uk). "During times of universal deceit, telling the truth becomes a revolutionary act" - George Orwell author of 1984.

Jobs quits. (Steve Jobs is the face and founder of Apple Computers). That was his latest bombshell announcement for Apple, a company with more discretionary cash than the United States and almost as much as oil industry giants. Some reports say more than them, too. Apple stock was down 5% on the news -- and this creates a great opportunity.

With new iPhones everyone must have, apps, new modes of computing, and above new ways of looking cool in a down economy, Apple is set to rise. The stock is expensive, but when it corrects, it will be an easy profit of at least 5 percent. Technology, style, iTunes, eBooks, and Apple are not going anywhere but up. Jobs' replacement has already been at the job since January.

And Jobs is not leaving completely but will still be hanging on advising and trying to spend his hundreds of millions to get his health back, what with a recent liver replacement and pancreatic cancer and helping the CIA/NSC/TSA defeat the concept or possibility of "privacy" in the Orwellian world of today. Remember, new investors, "Buy low, sell high." That's all one needs to know to capitalize on stock trades. Lows only come on bad news or when things are new. And one never really knows when the high has been reached (until after the fact with 20/20 hindsight).

Who needs educating? Not US (video)

(robertreich.org)

"If you think education is expensive...try ignorance."

The Public Video Project presents Prof. Robert Reich, former US Secretary of Labor, on why the US needs to save its schools NOW. The US financial sector has been "bailed out" while the crisis in education worsens. But human capital is more important to the long term health of America than capital markets. Never mind. Who needs educating?
